"Cross-complaints for harassment were filed, and LaBella's assault arrest was voided after detectives investigated further," New York Police Department Deputy Commissioner Paul Browne told reporters. Sources familiar with Lohan's probation for shoplifting in Los Angeles but not authorized to discuss it say the incident will not influence her probation. The struggle occurred about 5 a.m. Sunday at New York's Union Square W Hotel, where several people went to Lohan's room after a night of clubbing. Lohan told authorities that when she asked to borrow LaBella's cellphone, she discovered photos he had taken of her. He allegedly tried to grab the phone from her and Lohan says he tried to choke her and pushed her onto a bed before running out of the room. Lohan allegedly triggered the hotel fire alarm. LaBella initially was arrested but detectives decided not to pursue the case. He was identified in news reports as a congressional aide. Lohan, 26, was arrested last month In New York on suspicion of hitting a pedestrian outside a nightclub and then leaving the scene. She is on probation for a 2011 shoplifting incident at a Venice jewelry store. Prosecutors say until the New York incident is resolved, the status of Lohan's probation is unlikely to change. But security video from the hotel seems to show Lohan did not touch the alleged victim or did so in such a way that she would have never been aware. A judge early this year ended five years of probation for Lohan for driving under the influence after she completed extensive community service at the Los Angeles County morgue as well as therapy.
